
Whats changing for Nursing Homes in the OBBBA?

In this months Hurley Elder Care Law blogs, we have already discussed Medicaid and ABLE accounts; however, another critical area impacted by the One Big Beautiful Bill Act (OBBBA) is nursing home care.The law brings both opportunities and risks for residents and their families.Whats Changing for Nursing Homes?No Federal Staffing Requirements for 10 Years The new law blocks the federal government from enforcing minimum staffing standards in nursing homes for the next decade.This means no national mandates for nurse or aide hours per resident.
While states may still set their own rules, federal oversight is currently off the table.This is a dramatic reversal of the Biden Administrations initiative to increase staffing requirements in nursing homes.Transparency Rules Stay in Place Nursing homes must still report ownership details (including private equity ties), staffing levels, and use of contract workers.Families and advocates can access this information, helping them make informed decisions about care.Increased Renewal Requirements OBBA enables states to require more frequent Medicaid renewals (redeterminations), beyond the existing annual cycle.
